The Courthouse: Investigators recovered the rope used in the alleged assault and a gun they say Sweeney was not supposed to have due to a domestic violence protection order issued last year.

Court records state Sweeney was arrested for domestic violence in Kansas City in 2023.

“A rope was involved in the horseplay, but it wasn't for any threatening reasons,” Thorne Toliver, who is the stepfather to Sweeney’s son and was there the night of the alleged assault, said. “There was no intent to harm him, especially because he's gay. That really doesn't matter. Anybody who wants to be anything, they have a right I guess in this day and age, and that's not a problem for us or my family.”

Family members who say they were at the home that night believe the accusations have largely been a misunderstanding, and they never noticed anything out of the ordinary, adding the alleged victim has been over to their home numerous times before.

“I trust this man in my own house,” Thorne Toliver said. “I trust him on my property, and that's why he's here. If he was a threat to anybody at all, he wouldn't be allowed here.”
